With NIF 22962213W, e-mail info@pivotpro.es , makes available on its website www.pivotpro.es certain content on their activities and products. The general conditions governing the sole use of the website by USERS who enter in. The general conditions are available to the USER on the website www.pivotpro.es in each and every page and every time that a user enters their data into existing forms, to be read, printed, filed and accepted via internet, unable the USER to enter any data without prior acceptance.

Access to the website www.pivotpro.es implies unreserved acceptance of these general conditions of use that the user states fully understand. The user undertakes not to use the website and the services offered therein for conducting activities contrary to the law and respect at all times the general conditions.

ONE.- OBJECT
The PIVOTPRO website has been created with two aims – to offer third parties information about PIVOTPRO activities and therefore create lines of communication with third parties, and to sell PIVOTPRO products (Bikes, Folding Bikes and their accesories ) to those users who would like to purchase them.

2.1.-  The use of the website www.pivotpro.es does not carry mandatory registration of users. The conditions of access to and use of this website is strictly governed by the law and by the principle of good faith. Forbidden to commit acts that violate the legal rights or interests of others: the right to privacy, data protection, intellectual property etc.:
2.1.1.- Those actions that may damage the website or through it by any means any kind of damage to systems PIVOTPRO or to third parties.
2.1.2.- Without due authorization any advertising or commercial information directly or covertly, sending mass mailing (“spamming”) or sending large messages to block network servers (“mail bombing”).

2.2.- To access the PIVOTPRO website virtual store and make a purchase, it is necessary to obtain a user name and password by registering, which can be done by filling out a form with basic information. The user who possesses such access information is responsible for the security and confidentiality of communication and has the obligation and responsibility to protect this information to prevent access by unauthorised parties. The USER agrees to notify PIVOTPRO as soon as possible about any loss, theft or any other occurrence that may threaten data confidentiality.


2.3.- PIVOTPRO can, at any time, suspend user access to the website any usage is detected which is contrary to the law, good faith or the general terms - see clause six.

PIVOTPRO does not guarantee the truthfulness, accuracy or timeliness of the content and services in the exact moment of access of an USER.

3.4.- Any USER wishing to establish a hyperlink on its website to the PIVOTPRO website shall not be violating the law or the principle of good faith of the information made available on the aforementioned website.

3.4.3.- Do not include in your own website brand, trade name or any distinctive sign belonging to PIVOTPRO without the prior authorization of the entity.

3.5.- PIVOTPRO reserves the right to modify at any time the contents available on its website.

FOUR.- PROTECTION OF PERSONAL INFORMATION

4.1.- Informing the User of the file's existence and requesting their consent for the automated treatment of their data: The Service Provider hereby informs Users that the personal data they have provided on the forms found on the website will be handled strictly in accordance with the provisions set down in the Ley Orgánica 15/1999 of December 13th concerning Personal Data Protection (hereunder "LOPD") (Spanish Data Protection Legislation), and any other more recent legislation in this respect. It also informs the User that the said data will be kept on a file, of which the Service Provider is the titleholder, for its automated treatment and that the User in accepting these general terms is explicitly giving their consent to the treatment of their data.

4.2.-  The purpose of the data: The personal data provided by the User shall be treated by the Service Provider for the purpose of maintaining correspondence with the user and formalising the sale and purchase of its products and/or services, as well as for sending out regular special offers and commercial announcements via any media including electronic media. In any event, the data gathered and treated by the Service provider are basic data for the abovementioned purposes.

4.3.- Requirement for data entry: The fields containing an asterisk * in the forms are those that require a mandatory answer and not covered the consequence would be unable to buy or request the information needed.

4.6.-  Sharing of data: The User's data shall never be passed on to third parties without their prior consent and always in compliance with the regulations set down in the current legislation.The only communications data that can be made are logical for the same purpose with which were introduced, for example transport companies to proceed to deliver the goods at home, after communication arising from the legal relationship freely accepted.

4.7.- Security: The Service Provider hereby undertakes to guarantee the strict confidentiality and privacy of the gathered personal data and to this end has taken the necessary technical and organisational measures to prevent any alteration, loss, unauthorised treatment or access to the said data and guarantee its integrity and security; especially those provisions set down in Royal decree 1720/2007 of December 21st which approved the New Guidelines for Law 15/199 of December 13th, on the Protection of Personal Data. The Service Provider shall under no circumstances be held liable for any incidents that may arise concerning the personal data due to an attack or unauthorised access to the systems which is impossible to detect by existing security measures, or as a result of a lack of due diligence on the part of the User concerning the safeguarding of their passwords and their own personal data.  - see 2.2.

4.8. The veracity of the data: The User hereby is held liable for the veracity of their data, and promises not to enter false data and to proceed to change them if necessary..

FIVE.- RESPONSABILITY

5.1.-PIVOTPRO  in no event will be responsible for:
5.1.1.- Errors or incidents which may arise in communications, erased or incomplete transmissions in such a way that it does not guarantee that the website services are constantly operative.
5.1.2.- Any kind of damage that users or third parties may cause on the website.

5.2.- PIVOTPRO reserves the right to suspend access, at its own discretion, without notice, permanently or temporarily until it is assured of the effective responsibility of any damage that may have occurred. Also, PIVOTPRO will work with and notify the relevant authorities in such circumstances as soon as they have reliable knowledge that the damage constitutes any kind of illegal activity.

PIVOTPRO is a registered trademark, and it is prohibited to use in any way the PIVOTPRO brand, which includes both the name and logo, unless expressly authorised by PIVOTPRO, all rights reserved. Besides the PIVOTPRO website, the content, programming and design of the website is fully protected by copyright, and any reproduction, communication, distribution and processing is prohibited unless authorised by PIVOTPRO.

SEVEN.- APPLICABLE LAW AND JURISDICTION

These general terms are governed by Spanish law. The Courts of madrid will resolve any dispute or conflict arising from these general terms. The USER explicitly renounces any other jurisdiction that may be applicable.

EIGHT.-

Should any clause within this document be declared invalid, all other clauses will remain in force and shall be interpreted taking into account the will of the parts and the aim of the present terms. PIVOTPRO will not exercise any of the rights and powers conferred on this document, which will not imply in any way that these rights and powers are renounced unless expressed so by PIVOTPRO.
